Conditions of sale and use

I.The Maison and these conditions
These conditions govern use of the Nuvellique boutique at nuvellique.com (the Boutique) and every purchase made there. Nuvellique is a trade name. By ordering, you confirm you are 18 or older and accept these conditions and our note on privacy. “Purchaser” means you, the person who browses or orders.
II.Cosmetic products only
Nuvellique products are cosmetics. They are designed to improve the look and feel of skin; they are not drugs, make no therapeutic claim and are not meant to affect any disease or the body’s structure or function. Descriptions such as “smoother,” “firmer-looking” or “brighter” refer to appearance. Results vary with skin type, age, routine and environment, and are not guaranteed.
III.Patch test and safe use
BEFORE USING ANY NEW PRODUCT, APPLY A SMALL AMOUNT TO THE INNER ARM FOR 24–48 HOURS. STOP USE AND RINSE IF REDNESS, ITCHING, STINGING OR SWELLING OCCURS, AND CONSULT A DOCTOR IF IT PERSISTS. FOR EXTERNAL USE ONLY. AVOID CONTACT WITH EYES EXCEPT FOR THE EYE BALM AS DIRECTED. ALWAYS FOLLOW VITAMIN C OR OTHER ACTIVE PRODUCTS WITH SUNSCREEN IN THE DAYTIME. IF YOU ARE PREGNANT, NURSING, UNDER MEDICAL TREATMENT OR HAVE SENSITIVE OR BROKEN SKIN, ASK YOUR DOCTOR OR DERMATOLOGIST BEFORE USE. KEEP OUT OF REACH OF CHILDREN.

IV.Formulas and ingredients
We may refine formulas, packaging or ingredient sources from time to time. The ingredient list on the product you receive is the authoritative one, and may differ from images or descriptions on the Boutique.
V.Orders
An order is an offer to purchase, which we accept by dispatching the goods. We may decline or cancel an order, including where stock is unavailable, a price is shown in error or an order appears fraudulent, in which case any payment is refunded in full.
VI.Prices, samples and the welcome code
Prices are shown in U.S. dollars and may change before you order; taxes and delivery are confirmed at checkout. Two complimentary samples accompany each order while supplies last; samples have no value and cannot be chosen, exchanged or returned. The Cercle welcome code gives 10% off a first order, may be used once per Purchaser and household, cannot be combined with other offers, has no cash value and may be withdrawn if misused.
VII.Delivery
We deliver within the United States. Standard delivery (3–5 business days) is complimentary on orders over US$75; express delivery is offered at checkout for an additional charge. Dates are estimates. Risk passes to you on delivery. Please tell us within seven days if a parcel arrives damaged or is missing items.
VIII.Returns
Unopened products in their original, sealed condition may be returned within 30 days of delivery for a refund. For reasons of hygiene, opened products cannot be returned unless they are faulty. To arrange a return, write to us with your order number; return postage is at your expense unless the product is faulty or we sent the wrong item. Refunds are made to the original payment method within ten business days of receipt.
IX.Damaged or faulty products
If a product arrives damaged, leaks, or is faulty, send us a photograph within seven days of delivery and we will replace it or refund it, including delivery.
X.Gift coffrets
Coffrets are sold as sets and are returnable only as a complete, unopened set. A gift receipt may be requested; refunds for gifts are made to the original purchaser.
XI.Reviews and testimonials
If you leave a review, it must reflect your genuine experience with a product you have used. We do not pay for positive reviews or suppress negative ones, and we label any review given in exchange for a free product. By submitting a review you allow us to display it, with your first name or initials, on the Boutique and in our communications, and you confirm it doesn’t infringe anyone’s rights. We may decline reviews that are abusive, off-topic or make medical claims.
XII.Our creations
The Nuvellique name, product names, bottle illustrations, photographs and texts belong to us or our licensors and are protected by law. You may share links to the Boutique but may not copy or use our creations for any other purpose without written consent.
XIII.Conduct
Please do not misuse the Boutique: no unlawful use, fraudulent orders, purchasing for unauthorised resale, automated access or interference with its security.
XIV.Disclaimers
OTHER THAN AS STATED IN THESE CONDITIONS AND ANY WARRANTY THAT CANNOT BE EXCLUDED BY LAW, PRODUCTS AND THE BOUTIQUE ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF COSMETIC RESULTS.
XV.Limitation of liability
SO FAR AS APPLICABLE LAW ALLOWS, THE HOUSE OF NUVELLIQUE, MEANING NUVELLIQUE AND ITS FORMULATORS, SUPPLIERS AND AGENTS, IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS. ITS TOTAL LIABILITY FOR ANY CLAIM CONCERNING A PRODUCT SHALL NOT EXCEED THE PRICE YOU PAID FOR THAT PRODUCT. THIS DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
XVI.Indemnity
You agree to reimburse the House of Nuvellique for reasonable costs, including legal fees, arising from any third-party claim caused by your breach of these conditions.
XVII.Resolving disagreements
Please write to us first; we will respond within ten business days and try to resolve matters within 30 days. If we cannot, either of us may propose mediation by a mutually agreed mediator, conducted remotely, with costs shared equally. If mediation does not resolve the dispute within 45 days, or either of us declines it, the matter will pass to final arbitration, on an individual basis, administered by the AAA under the rules it applies to consumer cases. Small-claims court remains available. Class and representative proceedings are waived. Should you wish to be released from arbitration, a letter or email to us within thirty days of your first order is sufficient.
XVIII.Governing law
The law of the United States at the federal level governs these conditions, and neither of us will invoke a rule that substitutes another body of law. A matter that neither arbitration nor a small-claims court resolves will be placed before the federal judiciary of the United States, in a court competent to hear it.
XIX.Final provisions
If any provision is found unenforceable, the remainder applies. A delay in enforcing a provision is not a waiver. We may update these conditions; the version in effect on the date of your order applies to it. These conditions and our note on privacy are the complete agreement between us.
